Rochester man sentenced to 41 months after deadly crash
(ABC 6 News) – A Rochester man will spend more than three years in jail after a December 2020 dcrash that killed 24-year-old Joharmi Rubio.
Matthew Robert Shaver pleaded guilty to one count of criminal vehicular homicide–operating a motor vehicle with a BAC of .08 or more in September of this year.
The results of a blood draw showed Shaver as having a BAC of 0.155 at the time of the crash.
Information from Shaver’s Jeep Wrangler data recorder discovered that Shaver was traveling at a speed of 107 mph, 2 seconds before the crash and 92 mph, 0.1 seconds before the crash.
The posted speed limit was 45 mph.

Three other counts of criminal vehicular homicide were dismissed as a result of the plea deal.
Shaver was sentenced to 41 months at the Minnesota Correctional Facility in St. Cloud, as well as 600 hours of community service ” to be done in a way that would benefit the victim” in lieu of a $6,000 fine.
