Rochester man pleads guilty to deadly crash in December 2020

(ABC 6 News) – A Rochester man involved in a deadly crash in December 2020 pleaded guilty in Olmsted County Court last Thursday.

Matthew Robert Shaver, 29, of Rochester pleaded guilty to one count of criminal vehicular homicide – operating a vehicle with alcohol consumption .08 or more. Three other counts were dismissed as a result of the guilty plea.

According to the criminal complaint, on December 19, 2020, Rochester police were dispatched to the intersection of 18th Ave. NW and Crimson Ridge Drive in NW Rochester for a two-vehicle crash.

A Toyota Corolla driven by Luis Rubio Lunar and 24-year-old passenger Joharmi Rubio was rear-ended by Shaver at the intersection of 18th Avenue NW and Crimson Ridge.

Rubio suffered significant trauma from the crash and was pronounced dead at the scene. 

Both Lunar and Shaver were transported to a hospital where a blood draw on both parties was conducted. 

The results of the blood draw showed Shaver as having a BAC of 0.155 and Lunar as not having a measurable amount of alcohol in his system. 

Information from Shaver’s Jeep Wrangler data recorder discovered that Shaver was traveling at a speed of 107 mph, 2 seconds before the crash and 92 mph, 0.1 seconds before the crash.

The posted speed limit was 45 mph. 

Shaver is scheduled to be sentenced on October 18.
