(ABC 6 News) – David Ray Collier, 33, received a 15-year prison sentence in Olmsted County Court April 4, after pleading guilty to assaulting a peace officer.

Collier received credit for 415 days spent in Olmsted County custody.

Collier also pleaded guilty to 3rd-degree burglary and motor vehicle theft in separate Olmsted County cases dating back to 2021.

His 30-month and 23-month sentences for those charges will be served concurrently with the assault sentence, according to Minnesota Court Records Online.

(ABC 6 News) – A Kellogg man accused of firing a gun while police attempted to arrest him at a Rochester hotel pleaded guilty Friday, March 22.

David Ray Collier, 33, was originally accused of 2nd- and 4th-degree assault, attempted disarming of a peace officer, three counts of illegal possession of a firearm/ammunition, and one charge of 5th-degree drug possession after being arrested in a SE hotel lobby Wednesday, Feb. 15.

On March 13, Olmsted County Court amended Collier’s case and charged him with 1st-degree assault–use of deadly force against a peace officer; 2nd-degree assault with a deadly weapon; 4th-degree assault of a peace officer; attempted disarming of a peace officer; three counts of illegal possession of a firearm/ammunition; and one count of 5th-degree drug possession.

Olmsted County prosecution sought an aggravated, or longer-than-normal sentence of 20 years in prison, based on Collier’s long criminal history.

According to his plea agreement, Collier pleaded guilty to the charge of 1st-degree assault of a peace officer in exchange for a recommended sentence of 180 months, or about 15 years.

His sentencing is scheduled for April 4.

(ABC 6 News) – UPDATE: Olmsted County Court filed a motion to seek an aggravated or longer-than-normal sentence for a Kellogg man, if he is convicted of assault in a recent hotel shooting.

David Ray Collier, 33, faces charges of 2nd- and 4th-degree assault, attempted disarming of a peace officer, three counts of illegal possession of a firearm/ammunition, and one charge of 5th-degree drug possession after being arrested in a SE hotel lobby Wednesday, Feb. 15.

The state of Minnesota indicated that it intends to request the aggravated sentence based on Collier’s 12 different previous felony convictions, two of which were considered crimes of violence, and seven additional misdemeanor convictions.

Collier’s next court appearance is scheduled for March 21.

(ABC 6 News) – Rochester Police are investigating a shooting incident at a hotel in south Rochester early Wednesday morning.

Officers went to the hotel at 55 Wood Lake Drive SE, around 12:15 a.m. for a report of people with guns on the property.

According to police, a witness told officers that a man identified as David Ray Collier, 33 of Kellogg, had a gun and was walking through the lobby. Officers followed the suspect to a laundry room and approached him. As they went to handcuff him, the suspect refused lawful commands and physically resisted officers.

While he was resisting, Collier reached into his pocket and pulled out a firearm. Before officers could disarm him, Collier fired one shot that went into the floor. It took four officers several minutes to ultimately detain the suspect.

“RPD officers are dedicated professionals who respond to calls for service that often involve people who put police at substantial risk each and every shift. This was a dangerous situation with an armed suspect that could have easily resulted in the use of deadly force. The officers demonstrated courage, skill and quick action, leading to a safe conclusion and the apprehension of the suspect,” Chief Jim Franklin shared.

Callier had two active probation violation warrants issued this month. He has multiple felony convictions including burglary, fleeing a peace officer in a motor vehicle, controlled substance crimes and domestic assault.
