(ABC 6 News) - The Rochester Police Department said a driver involved in a traffic accident that resulted in a pedestrian being hit has been ticketed.

According to police, 45-year-old Raho Omer was driving a van northbound on Broadway when he attempted to turn westbound onto 2nd Street. Omer's van was hit by a truck travelling southbound on Broadway.

The van spun and hit 56-year-old Philip Hicks, who was in a crosswalk on Broadway.  Police said Hicks was thrown quite a bit and was taken to Mayo Clinic Hospital - Saint Marys Campus in critical condition. At last check he was upgraded to stable condition.

Police said both the truck and van had green lights but the van did not have a green arrow for right-of-way to turn.

Omer has been ticketed for failure to yield.

Previous story:

A man was taken to the hospital after being hit by a van at a popular Rochester intersection.
According to the Rochester Police Department, around 9:00 a.m. Monday there was a two-vehicle accident at the intersection of South Broadway and 2nd street SW.
Police said a minivan was driving north on Broadway when it turned left onto 2nd Street SW and was hit by a truck driving south on Broadway.  The impact caused the van to spin and hit a pedestrian in the crosswalk.

When police arrived on-scene they said the victim was lying int he road and was unconscious but did regain consciousness once inside the ambulance.
Even though the pedestrian was struck after the vehicles collided, it still brings up the concern about pedestrian safety.
"It's kind of like when you're driving your vehicle. When your light turns green, you should still look to your left and right before proceeding through the intersection to make sure it's safe. When you're crossing a sidewalk as a pedestrian I would encourage people to be assertive,” said Rochester Police Sergeant Eric Strop.
This isn't the first accident to happen on Broadway. In the last decade, there have been several accidents including a hit and run and a woman who was hit and killed right in the crosswalk.
"It's a good thing to be assertive of your surroundings for personal safety and vehicle safety," said Srgt. Strop.
Police said the man was taken to the Saint Marys where, as of last check, he was listed in stable condition with a head injury.
