Littering Leads to Alleged Drug Discovery

(ABC 6 News) -- A passerby's call to authorities about someone littering allegedly leads to the discovery of drugs on a Stewartville man.

Around 12:54 p.m. on March 29, a person called authorities after they watched garbage being thrown from a vehicle at the intersection of 4th Ave. and 5th St. in NE Stewartville.  

The caller said they were able to confront the two men inside the vehicle, who said they would go back and pick up the garbage.  However, the caller said the two never did pick up the garbage.

Olmsted County deputies were able to track the vehicle's license plate and spoke to the two men.  Deputies said the passenger, 25-year-old Michael Brett Judy of Stewartville, admitted to throwing the garbage out the window.

Deputies learned Judy had a warrant for misdemeanor theft, and when he emptied his pockets, deputies said a baggie with 3.5 grams of suspected cocaine was taken out.

Judy faces a fifth-degree felony possession charge.  Deputies said they made the driver pick up the garbage.
