(ABC 6 News)-- Federal agents with Customs and Border Protection watch for illegal activity at our borders every day, and it was just last week that they caught up with a sex offender from Dodge County.
41-year-old Santos Sanchez-Diaz was caught by U.S. Customs agents in Texas last Tuesday. He had been deported back in 1999 for third-degree sexual misconduct in which he served two years before being sent back to Mexico. Agents believe he may have been on his way back to Minnesota.
He's now charged with illegal re-entry after deportation, but it will be up to a judge to determine how long he'll remain in U.S. custody.
"It depends on various factors, he's going to be in federal custody probably up to a year until he has his criminal trial. And he's currently facing charges for entry of an aggravated felon. He will remain in custody until he has that trial. Depending on what the judge orders in terms of a sentence, he is looking up to 20 years in a federal prison," Chief Patrol Agent Felix Chavez said.
Diaz was caught swimming across a river near the Eagle Pass customs station when he was arrested.
