(ABC 6 News) - Dave Goslee, Deputy City Attorney for the City of Rochester said Vincent Barry notified him of his resignation from the Rochester Charter Commission Tuesday in an e-mail, effective immediately.

Barry was arrested Saturday after allegedly taking a car that was warming up in the parking lot of a SE Rochester restaurant.

According to the city's website, Barry's term was set to expire on December 31, 2020.

A 41-year-old man is in custody after allegedly stealing a car, which was warming in the parking lot of Fat Willy's in SE Rochester.

Police say the car's owner started his car outside the restaurant around 1:30 a.m. Saturday when he was approached by a man he knew, Vincent Michael Barry, who asked for a ride. The man declined and went back into the restaurant.

When he came out, he says he saw his car being driven away.

Police spotted the vehicle nearby, tried to stop it, but the driver sped up.

Police did not engage in a pursuit but followed the vehicle as it drove west on 48th Street and north on 11th Avenue SW, where it crashed into a ditch.

Police arrested Barry on-scene and are waiting for results of a blood draw as they have reason to believe he’d been drinking.

Barry faces charges for theft of a motor vehicle, fleeing an officer in a motor vehicle, and may face DUI charges pending the results of the blood test, according to police.
