TONIGHT AT 10: Monitoring the System

(ABC 6 NEWS) – Getting charged with a DWI is, among other things, expensive. One thing that can get costly is an alcohol monitoring program.

For the past 15 years, Olmsted County has been on contract with one alcohol monitor provider, Midwest Monitoring.

Recently a defendant went against the sheriff’s office mandate and decided to use a different provider which created quite the uproar.

"I have a client who is on pretrial release in several different counties and to require her to be on three separate through three separate providers with three separate fees is ridiculous,” said defense attorney Danielle DiFiore.

DiFiore and her defendant ultimately won over the Judge who denied the sheriff’s office motion to allow defendants in Olmsted County to only use their provider.

Over the past month, ABC 6 News Anchor Karsen Forsman has been reviewing court documents and talked to one defendant who says she was forced to use and pay for the Olmsted County Sheriff’s Office monitoring program.

The defendant didn’t want to be identified fearing for her future. We talked to her just a few hours after she was released from jail. She explained the process of getting a monitor in Olmsted County.

"It was just like, ‘well, sorry, this is what you have to do to get out, and you're not getting any help,’” she said. "I was taken advantage of because I had no other options."

Tonight on ABC 6 News at 10, Karsen looks into how much money the sheriff’s office has collected from the program over the last ten years. He’ll also have a response from the Olmsted County Sheriff’s Office.

Viewers will also find out why Olmsted County District Judge Joseph Chase decided in favor of the defendant using a different provider. Karsen also looked into other surrounding counties to see their process for DWI pretrial release and if they are on contract with an electronic alcohol/home monitoring provider.
