(ABC 6 NEWS) -- New details have emerged involving the police shooting death of Austin native Michael Tray.
As we've reported, Tray was killed by Minnetonka Police in October. Today, we obtained a copy of the Hennepin County grand jury report.
According to the document, at the time of the shooting, Tray had an unloaded revolver, but was intoxicated and would not put the gun down.
Police officers didn't know if the gun was loaded, but say Tray took a step toward them and said, "If you want the gun, why don't you come get it?"
Police also say they shot once when tray placed his hand near the gun, which was in his waistband, and then shot again when they saw the gun out of his waistband.
Tray was shot a total of six times.
The officers have been cleared of any wrongdoing.
