Iowa State Student Loses Appeal in Suit Over Fall

DES MOINES, Iowa (AP) - The Iowa Court of Appeals has upheld a judgment against a student who had sued an Iowa State University fraternity and two of its members for his fall out of a third-story window in 2008.
 
Des Moines television station KCCI reports that Kaleb Stebens was 18 at the time of the accident.
 
Stebens sued FarmHouse Fraternity, saying it was responsible for his injuries because he was told he had to leave open a window in his room.
 
Stebens has a history of sleepwalking and testified that he believes that was why he fell out the window.
 
Stebens also claimed two frat members were responsible for providing him alcohol at a party earlier, elsewhere in Ames.
 
The court says there was no evidence that alcohol contributed to Stebens' fall.
